Pursuant to subsection 5.9(2) of the Aeronautics Act, and after taking into account that the exemption is in the public interest and is not likely to affect aviation safety, I hereby exempt Prince Edward Air Ltd., 250 Brackley Point Road, Charlottetown, PE, C1A 6Y9 from the requirement of paragraph 704.108(1)(d) of the Canadian Aviation Regulations, subject to the conditions set out below.
The paragraph states that no air operator shall permit a person to act and no person shall act as a flight crew member in an aircraft unless that person has fulfilled the requirements of the air operator’s ground training program and except where undergoing line indoctrination training, the air operator’s flight training program.
PURPOSE
The purpose of this exemption is to allow Jason Parker Licence No AA411655 and Mike Ivany Licence No AA413126 to act as flight crew members on the BE99 and for Jason Parker Licence No AA411655 to act as a flight crew member on the BE20, both aircraft operated by Prince Edward Air Ltd., without completing line indoctrination training.
APPLICATION
This exemption applies to Jason Parker and Mike Ivany of Prince Edward Air Ltd. acting as flight crew members on the BE99 aircraft and to Jason Parker of Prince Edward Air Ltd. acting as a flight crew member on the BE20 aircraft while both the BE99 and BE20 aircraft are operating under CARs Subpart 704 pursuant to AOC No 7259.
CONDITIONS
This exemption is subject to the following conditions:
1. Jason Parker and Mike Ivany shall complete a line check on the BE99 aircraft administered by a Transport Canada inspector where they shall be required to perform or show knowledge of, as applicable, a mandatory list of operating maneuvers and procedures as detailed in Commercial Air Service Standards subsection 724.115(27)
2. Jason Parker shall complete a line check on the BE20 aircraft administered by a Transport Canada inspector where he shall be required to perform or show knowledge of, as applicable, a mandatory list of operating maneuvers and procedures as detailed in Commercial Air Service Standards subsection 724.115(27)
3. This exemption shall become part of Jason Parker and Mike Ivany’s training records.
4. Jason Parker and Mike Ivany shall have completed all training requirements in accordance with Prince Edward Air Ltd. approved training program, exclusive of line indoctrination training.
5. A copy of this exemption shall be carried on board each BE99 and BE20 aircraft.VALIDITY
This exemption is in effect until the earliest of the following:
- ADT at midnight on July 30, 2004
- the date on which any condition set out in this exemption is breached; or
- the date on which this exemption is cancelled in writing by the Minister where he is of the opinion that it is no longer in the public interest or is likely to affect aviation safety.
